Announcement November 6, 2013:
PUBLIC HEARING AND DEADLINE FOR PUBLIC COMMENT ON PROPOSED ADMINISTRATIVE RULES FOR PART 201, ENVIRONMENTAL REMEDIATION, OF THE NATURAL RESOURCES AND ENVIRONMENTAL PROTECTION ACT, 1994 PA 451, AS AMENDED (NREPA), LANSING, INGHAM COUNTY. The DEQ Remediation and Redevelopment Division (RRD) will conduct a public hearing on proposed administrative rules promulgated pursuant to Part 201 of NREPA. The rules are identified as R 299.1 – R 299.50. The purpose of the rules is to implement the December 2012 amendments to the NREPA. The DEQ is required to evaluate and revise the cleanup criteria established under Section 20120a of the NREPA by December 31, 2013. The public hearing will be held from 2:30 p.m. to 4:30 p.m. on Wednesday, November 13, 2013 in the Con Con Conference Room on the Atrium Level, Constitution Hall, 525 West Allegan Street, Lansing, Michigan.

Copies of the proposed rules (ORR 2013-056 EQ) can be obtained in two ways: 1) downloaded via the Internet through the Office of Regulatory Reinvention at www.michigan.gov/orr (in the far left margin, select “Pending Rule Changes” and then “Environmental Quality,” then scroll down to “Cleanup Criteria Administrative Rules for Part 201”), or 2) calling, writing or e-mailing the DEQ/RRD at: P.O. Box 30426, Lansing, Michigan 48909-7926 (attention: Bob Reisner); Phone: 517-284-5141; Fax: 517-241-9581; reisnerr@michigan.gov.

All interested persons are invited to attend and present their views, however, oral statements must also be submitted in writing for the hearing record. Anyone unable to attend the hearing may submit comments in writing. Written comments must be received at the above address by 5:00 p.m. on November 13, 2013. Persons needing accommodations for effective participation in the meeting should contact the RRD at 517-284-5141, one week in advance to request mobility, visual, hearing, or other assistance. This notice of public hearing is given in accordance with Sections 41 and 42 of Michigan’s Administrative Procedures Act, 1969 PA 306, Michigan Compiled Laws (MCL) 24.241 and 24.242. Administration of the rules is by authority conferred on the Director of the MDEQ by Sections 20104(1) and 20120a(18) of the NREPA, MCL 324.20104(1) and 324.20120a(18). These rules will become effective immediately after filing with the Secretary of State.

Update February 23, 2012:
The dispute resolution (Petition for Dispute Resolution) hearing on the Western Area Monitoring Plan was heard on Wednesday, January 11, at 1:30 PM, at 101 E. Huron Street, second floor, Ann Arbor, in the court room of the Honorable Donald E. Shelton.

Honorable Judge Shelton ruled for Gelman Sciences d/b/a PALL Life Sciences, Inc.'s (Defendant)at the hearing "without prejudice" .The ruling allows for the MDEQ to still rejoin the issue with better supporting documentation. The outcome of the ruling is that Gelman/Pall Life Sciences will not be required to install additional compliance monitoring wells, as requested by the MDEQ.The proposed additional compliance monitoring wells were to be installed at proper depths and closer to the known plume(s) at the core area, to aid in determining if the Consent Judgement requirement of non-expansionis achieved.

Recent 1,4-Dioxane Related Events:

USEPA requesting comments on proposed revisions to UCMR 3 on or before May 2, 2011.

The proposal for the third Unregulated Contaminant Monitoring Regulation (UCMR 3) was signed by EPA Administrator, Lisa P. Jackson on February 17, 2011. As proposed, UCMR 3 would require monitoring for 30 contaminants using EPA and/or consensus organization analytical methods during 2013-2015. Together EPA, States, laboratories and public water systems (PWSs) would participate in UCMR 3.

1,4-dioxane is included in the Proposed Contaminant List, consisting of 30 contaminants.

Comments must be received on or before May 2, 2011.

Environmental Working Group - Drinking Water Quality Database

The Environmental Working Group has created a drinking water quality database of municipal water supply systems, as part of an extensive three year project. Following is the link for information on municipal supplies reporting detections of 1,4-dioxane. The site does not include the latest EPA IRIS levels for this compound which are nearly an order of magnitude lower than listed on the site.

EPA includes 1,4-dioxane to Final Contaminant Candidate List 3 (CCL 3)

Excerpt from EPA: "CCL 3 is a list of contaminants that are currently not subject to any proposed or promulgated national primary drinking water regulations, that are known or anticipated to occur in public water systems, and which may require regulation under the Safe Drinking Water Act (SDWA). The list includes, among others, pesticides, disinfection byproducts, chemicals used in commerce, waterborne pathogens, pharmaceuticals, and biological toxins. The Agency considered the best available data and information on health effects and occurrence to evaluate thousands of unregulated contaminants. EPA used a multi-step process to select 116 candidates for the final CCL 3. The final CCL 3 includes 104 chemicals or chemical groups and 12 microbiological contaminants."
